Wilmington, Ohio man arrested by FBI connected to participation in US Capitol riot

A man from Wilmington, Ohio, who reportedly traveled to Washington D.C. on Jan. 6 to participate in protests, has been arrested and charged with online threats and witness tampering, the Department of Justice said.

The FBI's Joint Terrorism Task Force arrested Justin Stoll, 40, Friday morning and charged him with online threats and witness tampering related to his participation in protests at the U.S. Capitol.

According to the criminal complaint unsealed Friday, The FBI received a tip about threatening posts by a user called “Th3RealHuckleberry” made on the app, "Clapper."

After an open-source investigation, the DOJ said it believes it was Stoll who used the username “Th3RealHuckleberry” on the app Clapper and on YouTube to post videos related to his participation in the Capitol protests.

The FBI matched photos from the Clapper account to a Facebook profile of one of Stoll's relatives which led the FBI to match Stoll's driver's license photo to the man in the Clapper account profile, according to the complaint.

In videos posted to the Clapper account, Stoll allegedly asks if he should wear a black United States flag shirt to D.C., saying, “Basically, if you are an enemy combatant, you will be shot on sight I know this is the end-all flag”

Stoll also allegedly posted videos of himself outside the Capitol with other protesters where he said, “D.C.’s a war zone!...You ain’t got enough cops, baby! We are at war at the Capitol. We have taken the Capitol. This is our country.”

Another user on Jan. 7, the day after the protests, commented on one of the videos on Clapper:

"Cool I'm glad I saved this video 101I hope you really went in the capitol bldg. You'll have 10 years of free room and board waiting for you."

Stoll allegedly posted a video response where he said:

Snitch b***h first thing in the morning. Let's see what the rat f**k has to say, shall we? 'Cool, I'm glad I saved this video, 101.I hope you really went into the capitol building. You'll have 10 years of free room and board waiting for you.' Well, that shows your f***ing ignorance because clearly, the capitol building is owned by the people, so again, nothing will happen. Secondly, I never admitted I went into it, did I? Go watch the video again. Daddy's not stupid. [Wink.]

The DOJ is alleging Stoll broke the law in the next part of the video:

Third, if you ever in your f***ing existence did something to jeopardize taking me away from my family, you will absolutely meet your maker. You can play that for the D.A. in court, I don't care. If you ever jeopardize me,from being with my family, you will absolutely meet your mother f***ing maker, and I will be the one to arrange the meeting. So go ahead andplay that shit, b***h. Keep this video. You might need it one day.

The DOJ claims that Stoll violated 18 U.S.C. 875(c) (interstate communication of a threat) and 18 U.S.C. l5l2(b)(3) (tampering with a witness by threat) with the video.

In the criminal complaint, the FBI said its earlier tip alleged that Stoll threatened an unnamed politician in a video. The FBI said it has not found that video, but is currently reviewing other videos on the Clapper account.

U.S. Attorney for the Southern District of Ohio, David DeVillers tweeted a warning last week that anyone from his district who committed crimes at the U.S. Capitol will be prosecuted.

Justin Herdman, the U.S. Attorney for the Northern District of Ohio, also said anyone who committed federal crimes at the US Capitol from northern Ohio will be held accountable.
